BILL MAKES BURGLARY/RAPE A VIOLENT CRIME! |

HB 172 Drastically
Increases Sentences for Burglar/Rapists
At the suggestion of Commonwealth's Attorney
Rob Sanders, State Representative Joe
Fischer (68-Ft. Thomas) filed HB 172
for consideration by the KY state
legislature. If passed, HB 172 would
add Burglary to the list of violent offenses
when the underlying crime is a felony sex
offense. The impact of the change
would increase the amount of time a
Burglar/Sex Offender would have to serve
before being eligible for parole from 20% to
85%.
Under current law, Burglary is only
classified as a "violent offense"
when the underlying crime is a kidnapping
or felony assault. "It just
doesn't make sense that burglary committed
to accomplish a rape isn't included in that
list," said Rob Sanders. "I
can only assume it was an oversight when the
law was originally written."
Sanders said the "flaw" in the
system became apparent to him in 2007 during
his prosecution of Rodney McMillan on the
charges of First Degree Burglary and
Attempted Rape. McMillan was charged
after DNA evidence proved he had broken
into a woman's apartment in Gen. Mitchell
Park in Ft. Mitchell and attacked her while
she slept. The case gained notoriety
because McMillan filmed the attack and
appeared in the video wearing only a woman's
thong and socks on his arms. The video
camera was left behind when McMillan fled
the apartment when his victim awoke and
fought him off. McMillan pled guilty
to both charges and received the maximum
sentence on each.
"I was stunned to learn that McMillan
would only be required to serve 20% of his
burglary sentence before meeting the parole
board," said Sanders. Ironically,
while the Attempted Rape (5-10 years)
carried only half the penalty of the First
Degree Burglary (10-20 years), the parole
eligibility was 4 times higher. The
result was that McMillan would serve at
least 8.5 years on the sex charge but only 2
years on the burglary.
"Obviously the victim would consider
the offense violent and I think most folks
would agree," Sanders said. He
added "As soon as the case was over I
sent an email to the entire NKY Legislative
Caucus and Rep. Fischer stepped right
up." Sanders said he hopes that
with Rep. Fischer's position as vice-chair
of the House Judiciary Committee that the
bill will receive significant attention.

On 12/12/06,
John T. Bradford Jr. was stopped by
Covington Police Officer John Mangus for a
routine traffic violation. Bradford's
front seat passenger was discovered to have
a warrant and subsequently arrested.
Search of the passenger revealed crack
cocaine in her purse. Search of the
vehicle incident to arrest revealed a large
rock of crack cocaine in the center console
and a baggie with cocaine residue in
Bradford's pocket. Bradford was then
arrested too.
While transporting Bradford to the Kenton
County Detention Center, Covington Police
Officer Chris Dees noticed that Bradford
squirming around in the back seat.
Dees recognized these furtive movements as
indicative that his prisoner may be trying
to hide something under the seat.
After walking Bradford into jail, Dees
returned to the car and searched the back
seat where he found approximately 20g of
crack cocaine. A more thorough
search of Bradford inside the jail
revealed additional crack cocaine and
ecstasy tablets in his sock.
Bradford was then charged with Trafficking
in a Controlled Substance (cocaine).
At trial Asst. Commonwealth's Attorney
Sharif Abdrabbo presented testimony from
an expert witness from the NKY Drug Strike
Force who told the jury that 20g of
cocaine is far more than anyone would
possess for personal use. When
combined with the $925 dollars found on
Bradford's person, the additional drugs,
and the drugs located on the passenger,
this evidence easily suggests that
Bradford was a drug dealer, not just a
user. Despite this testimony, the
jury returned a guilty verdict for only
Possession of a Controlled Substance
(cocaine) and not the more serious
Trafficking charge. After a
sentencing hearing, however, the jury
recommended the maximum punishment of 5
years in prison.
Kenton Circuit Judge Patricia Summe
scheduled final sentencing in the case for
February, 2008.

In
May of 2007, a former basketball coach from
Holmes High School reported to Covington
Police that his home on Covington's Eastside
had been burglarized. The thieves gained
entry by ripping an air conditioner from a
window and removed numerous guns from a
display case. Both the air conditioner
and the gun case were destroyed in the
process. The homeowner indicated to
police that he suspected that Jefferson was
involved but investigators did not have much
to go on.
A few days later, Covington Police
responded to an armed confrontation at a
suspected crack house. Officers
identified Jefferson as one of the persons
involved and tracked him to a relative's
home. Their investigation produced
some of the firearms taken in the
burglary. Jefferson, Hall, and two
other subjects were then taken to the
police department for an interview.
During questioning by Covington Police
Detective Ted Edgington, Jefferson and
Hall each admitted to having stolen the
firearms in the burglary. Both were
arrested and charged with First Degree
Burglary. Hall, a juvenile at the
time, was transferred to Circuit Court to
stand trial as an adult.
On 1/11/08, Jefferson and Hall pled guilty
to Second Degree Burglary. In
exchange for the reduced charge, both
Jefferson and Hall agreed to testify
against participants in the burglary
and the armed confrontation. Final
sentencing is set for 3/14/08.
Jefferson and Hall each face a sentence of
5-10 years in prison.

v. Lemuel Crawford

Acting
on information from a confidential informant
(CI) the NKY Drug Strike Force (NKDSF) began
an investigation into cocaine trafficking by
Lemuel Crawford. On two occasions in
March, 2007, Crawford sold cocaine to the CI
at a house in Covington. The
transactions were recorded by a hidden video
camera and microphone.
On
12/13/07, Commonwealth's Attorney Rob
Sanders presented the case against Crawford
and about 30 other drug traffickers
investigated by the NKDSF directly to the
Kenton County Grand Jury for Indictment.
On 1/14/08 Crawford became the first of the
drug dealers indicted in the "round
up" of on-going investigations to plead
guilty. Commonwealth's Attorney Rob
Sanders is recommending a 7 year sentence
for Crawford. Final sentencing is set
for 3/11/08. Crawford still faces
another charge of Trafficking in a
Controlled Substance (cocaine) from a
separate investigation by Covington Police
Dept.'s Bureau of Strategic Support.

PRISONER'S
LAWSUIT SAYS IT WAS TOO EASY TO ESCAPE
Scott
Anthony Gomez Jr. made his first break from
the Pueblo County Jail two years ago.
He pushed up a ceiling tile, hoisted himself
into the ventilation system and climbed until
he reached a roof. Then he shinnied down the
wall on bedsheets fashioned into a rope.
Caught two days later, he was back in his
cell.
The next time, Gomez again pried loose a
ceiling tile and vanished into the guts of the
building. But as he tried to rappel on
bedsheets down the side of the 85-foot
building, he fell.
Now the would-be Houdini is suing the sheriff
of the southern Colorado county, saying
authorities caused his injuries by making it
too easy to fly the coop.
"Defendants . . . did next to nothing to
ensure that the jail was secure and the
plaintiff could not escape," says Gomez's
lawsuit, which seeks an unspecified amount of
money.
Filed this month in federal court in Denver,
the case has attracted attention statewide and
on the Internet, mostly from people chuckling
and fuming at Gomez's legal efforts.
