GUILTY  
Commonwealth v. Daniel T. Searpadrienne peacock
Judge: Bartlett
Prosecutor: James T. Redwine
Police Agency: Ft. Wright
 
On 6/2/07, police were called to a residence in Ludlow by Dixie Searp who reported that she had been beaten by her husband, Daniel Searp, who had fled the scene.  Daniel Searp, who has a history of domestic abuse, was located walking up Sleepy Hollow Road by Ft. Wright Police Sgt. Michael Knight.  Searp ignored Knight's commands to stop and fled into the woods leading to an extensive search by Ft. Wright, Ludlow, Park Hills, and Ft. Mitchell Police.  Searp eventually showed back up at the residence where the call originated and was arrested.
 
On 1/24/07, after a 2 day trial, the jury found Searp guilty of 1st Degree Fleeing Police and Harassment.  The jury then followed the suggestion of Asst. Commonwealth's Attorney James T. Redwine and recommended a 2 1/2 year sentence for the Fleeing charge and 45 days for Harassment.  On 2/25/08, Sear appeared in court for final sentencing.  The Commonwealth recommended that the Court follow the recommendation of the jury.  Searp was sentenced to 2 1/2 year probated for 5 years on the Fleeing charge and 45 days for Harassment.
GUILTY  
Commonwealth v. Dwight Talleydwight talley

On 8/30/08, the Covington Police Bureau of Strategic Support (BOSS) was investigating a reported crack house within the Jacob Price Housing Project.  Undercover officers Robert Rose and Aaron Mears equipped a confidential informant (CI) with a hidden video and audio transmitter and sent the CI towards the targeted apartment.  While en route to the suspect address, Dwight Talley stopped the CI and offered to sell the CI crack cocaine.  The CI agreed and purchased one rock for $20 of marked money provided by the police. 
 
The CI then continued on to the targeted apartment and was invited in.  Once inside, the CI requested to purchase $40 worth of crack cocaine.  The crack dealer in the house only had a $20 rock available and the CI complained about not getting the CI's money's worth.  In an effort to maintain customer satisfaction, that dealer yelled out the window to Talley who was still loitering about.  Talley was more than happy to supply the remaining portion of crack cocaine.  In doing so, Talley managed to earn himself not one, but two charges of Trafficking in a Controlled Substance (cocaine).  Upon checking his criminal history, Mears and Rose learned that Talley was on parole for... you guessed it... Trafficking in a Controlled Substance (cocaine).
 
Talley was arrested the following day after the Covington SWAT Team conducted a search warrant at the same residence in Jacob Price.  Talley was not in the residence at the time but was promptly found loitering just outside in the same area as he was dealing the day before.  Talley was indicted in November, 2007 and on 2/25/08 pled guilty to 2 counts of Trafficking in a Controlled Substance (cocaine).  Asst. Commonwealth's Attorney Sharif Abdrabbo is recommending that Talley serve 5 years on each count in addition to the remaining time on his previous sentence.  Final sentencing is set for 3/25/08.

Commonwealth v. Charles Jackson Jr.adrienne peacock

On 1/15/08, Jackson pled guilty to Failure to Register as a Sex Offenders and 2nd Degree Persistent Felony Offender.  Asst. Commonwealth's Attorney Laura Ward recommended a sentence of 5 years in prison.  On 2/25/08 Jackson was sentenced to 5 years probated for 5 years.
 
Commonwealth v. Michael Fleckingermichael fleckinger

Prosecutor: Joseph Meadows 
Police Agency: KY Dept. of Insurance
 
On 2/26/08 Fleckinger pled guilty to 13 Counts of Fraudulent Insurance Act (>$300).  Asst. Commonwealth's Attorney Joe Meadows is recommending a sentence of 6 years probated for 5 years on the condition that the defendant serve 12 months of home incarceration monitored by Kenton County's new ankle bracelet GPS system (known as MCR for Monitored Conditional Release).  Final sentencing is set for 4/7/08.
 
Commonwealth v. Dominic Carboneadrienne peacock

Police Agency: Ludlow
 
On 1/25/08 Carbone pled guilty to Possession of a Controlled Substance (cocaine).  Asst. Commonwealth's Attorney Joe Meadows recommended a sentence of 5 years in prison.  On 2/25/08, Carbone was sentenced to 3 years in prison.

On 1/25/08 Carbone pled guilty to Trafficking in a Controlled Substance (cocaine) in an unrelated case to the one listed above.  Asst. Commonwealth's Attorney Joe Meadows recommended a sentence of 5 years in prison.  On 2/25/08, Carbone was sentenced to 5 years in prison.

On 2/25/08 Shepherd pled guilty to Wanton Endangerment 1st Degree and Carry a Concealed Deadly Weapon.  Asst. Commonwealth's Attorney Jim Redwine is recommending a sentence of 3 year probated for 5 years.  Final sentencing is set for 3/25/08.
 
 
Commonwealth v. Joseph Youngadrienne peacock

On 2/25/08 Young pled guilty to Fraudulent Use of a Credit Card.  Asst. Commonwealth's Attorney Alysha McKinney recommended a sentence of 1 year in prison.  Young was sentenced to 1 year in prison.

On 2/25/08 Mattox pled guilty to Possession of a Controlled Substance (cocaine).  Asst. Commonwealth's Attorney Sharif Abdrabbo is recommending that Mattox, who has no previous felony record, be ordered into the Felony Diversion Program for 2 years.  Final sentencing is 3/11/08.  If Mattox fails diversion she faces 1-5 years.

On 2/25/08 Carlson pled guilty to Fraudulent Use of a Credit Card.  Final sentencing is set for 3/25/08.  Carlson is facing 1-5 years in prison.

On 1/29/08 Sparks pled guilty to Theft (>$300).  Asst. Commonwealth's Attorney Leanne Isler recommended that Sparks go to prison for 4 years.  On 2/25/08 Sparks was sentenced to 5 years probated for 5 years on the condition that he serve 6 months in the county jail.
 
Commonwealth v. Junie Holtadrienne peacock

On 1/28/08 Holt pled guilty to 1st Degree Burglary, 1st Degree Robbery and 1st Degree Persistent Felony Offender.  Asst. Commonwealth's Attorney Joe Meadows recommended a 10 year sentence.  On 2/25/08 Holt was sentenced to 10 years in prison.
 
 
Commonwealth v. Christopher Thornberryadrienne peacock

On 1/11/08 Thornberry pled guilty to Trafficking in a Controlled Substance (non-narcotic substance).  Asst. Commonwealth's Attorney Joe Meadows recommended a sentence of 4 years probated for 4 years on the condition that Thornberry serve 3 months in jail. On 2/25/08 Thornberry was sentenced to 4 years probated for 4 years and was ordered to remain in the county jail until a bed opens in an inpatient drug treatment facility.

On 2/21/08 Nance pled guilty to Flagrant Non-Support.  Asst. Commonwealth's Attorney Amy Burke is recommending a 3 year sentence probated for 5 years.  Final sentencing is set for 3/31/08.

OP/ED: A COMEBACK FOR THE CRIME ISSUE

From Pakistan to Serbia, and recurrently in Iraq, the headlines point to the dangers of the world -- most notably the threat of terrorism. And yet when the polling firm Cooper & Secrest Associates asked 1,139 Americans in December which threat they took most seriously, 69 percent chose violent crime and only 19 percent named terrorist attack.

 The survey was part of a striking report released yesterday by Third Way, a liberal think tank, and several governors, warning that the crime issue, which has slipped off the political agenda since its heyday in the 1970s and 1980s, is about to return.

 "Four new and dangerous sociological trends are converging to disturb the peace and are threatening a crisis of crime, if not addressed," the report says.

 The trends it cites include a huge increase in the number of criminals due to leave prison in the next five years, the infiltration of criminal gangs into the surge of illegal immigrants, the bulge in the number of young people entering the highest-crime years and the technology revolution that has made the Internet a place of danger for unsupervised youths.

 The underlying numbers are startling. Twenty years ago, the country's total prison population was 700,000. Next year alone, that many will be released from prison, and, if past trends hold, nearly two-thirds will be rearrested.

 In the next five years, the number of young adults and teenagers will have increased by 1 million, and, if past patterns hold, that will boost the number of crimes by 2.5 million.

 The Third Way report is chock-a-block with hopeful examples of what some states are doing to head off this explosion. But the bad news is that the federal government seems to be in retreat.
