James
T. Redwine Promoted To
1st Assistant Commonwealth's Attorney
Commonwealth's Attorney Rob Sanders is
proud to announce the promotion of Asst.
Commonwealth's Attorney James T. Redwine
to First Assistant Commonwealth's
Attorney. The promotion becomes
effective March 6, 2008 when Redwine is
sworn into his new role by Kenton Circuit
Judge Martin J. Sheehan. The First
Assistant Commonwealth's Attorney is
formally known as Commonwealth's Attorney
Pro-Tem and functions as Commonwealth's
Attorney whenever the elected
Commonwealth's Attorney is out of the
jurisdiction or otherwise unavailable.
"This is a hard earned achievment for Jim a
special occasion for both of us,"
said Commonwealth's Attorney Rob Sanders.
"We share a passion for prosecuting,
a tireless work ethic, and an unrelenting
pursuit of justice," said Sanders, "But otherwise,
we're polar opposites."
Sanders went on to say "The balance
makes us both better prosecutors."
Redwine and Sanders each began
prosecuting felony cases in 1999 as
Assistant Commonwealth's Attorneys to
then-Commonwealth's Attorney Don Buring.
"We both had the benefit of learning
from the best in the business, like Don
Buring, (former 1st Assistant and now
Asst. U.S. Attorney) Tony Bracke, and
(retired Commonwealth's Detective) Jack
Denham," said Sanders, "And we
each owe a lot of our success to our
teachers."
Jim Redwine graduated from University of
Kentucky with a degree in Political
Science in 1981 and earned his law degree
from Chase College of Law in 1984.
Before prosecuting, Redwine had a wide
range of experience including private
practice, insurance law, and managing a 7
doctor medical practice. In 1994,
Redwine joined the Kenton County
Attorney's Office and began his
prosecuting career. In 1999, Redwine
moved to the Commonwealth's Attorney
Office in Kenton County and has also
proseucted felonies for the Campbell
County Commonwealth's Attorney and the
Kentucky Attorney General's Special
Prosecutions Division.
Redwine has won numerous major cases over
the course of his prosecuting career but
maintains that his biggest accomplishment
was marrying Beth, his law school
sweetheart and wife of 24 years. Jim
and Beth have two children, Eliza and
Jacob, and make their home in Kenton
Hills. In his little spare time,
Redwine enjoys serving as a referee for
local high school basketball games and is
a member of the 9th Region Basketball
Officials Association.

In November, 2007, members of the
Covington Police Bureau of Strategic
Services (BOSS) were conducting an
under-cover prostitution sting
commonly known as a "john
detail." Covington Police
Detective Joanne Rigney was loitering in
the area of East 16th Street in full
costume including multiple (fake) tattoos
and missing (blacked out) teeth. On
most occasions, undercover detectives
arrest scores of "johns"
offering various amounts of money in
exchange for a wide array of sexual acts.
On 11/13/07 Joseph Jordan approached Det.
Rigney and requested oral sex. What
made this occasion unusual was the fact
that Jordan offered to pay for the act in
crack cocaine rather than cash. Sgt.
Rob Nader and Detectives Rob Rose and
Aaron Mears, who were conducting
surveillance, promptly converged on Jordan
and arrested him. Search incident to
arrest revealed that Jordan possessed in
excess of 7 grams of crack cocaine.
Jordan was indicted for Trafficking in a
Controlled Substance (cocaine) by the
Kenton County Grand Jury in January, 2008.
On 3/4/08, Jordan pled guilty as charged.
Commonwealth's Attorney Rob Sanders is
recommending a sentence of 5 years in
prison. Final sentencing is set for
4/1/08.

LEGISLATION
SEEKS STRICTER STATE RAPE LAW, TARGETS FRAUD
AND DECEIT
A
bill filed yesterday would expand the scope of
the state's rape law, allowing prosecutors to
bring charges against those who use fraud or
deceit, not just physical force, to engage in
sexual intercourse.
Proponents
said the existing law must be tightened after
a Westfield man allegedly had sex with his
brother's girlfriend while posing as his
brother in a darkened room and after a
Wilbraham pharmacist allegedly posed as a
gynecologist and gave exams to two women.
The
Supreme Judicial Court ruled last year that
the Westfield man could not be convicted of
rape because sex obtained through fraud is not
a crime, and Hampden County prosecutors
decided last month that they could not bring
rape charges against the pharmacist for the
same reason.
In
its ruling last year, the state's highest
court urged the Legislature to address the
issue, a process begun this week.
