GUILTY    
Commonwealth v. James Deaverjames deaver

In August of 2006, a social worker Kentucky Cabinet for Families and Children's Dept. of Community Based Services reported to Covington Police that James Deaver, 40, of Newport, was believed to have impregnated his sister, Linda Deaver, 37.  Covington Detective Brian Frodge discovered that James Deaver was a registered sex offender after having been convicted of Incest in Campbell County in 1998.  Det. Frodge also learned that the prior Incest conviction was the result of a consensual sexual relationship with Linda Deaver.  The prior relationship resulted in the birth of a child that was seriously developmentally delayed. 
 
After awaiting the birth of the second child, Frodge obtained DNA sampled from the child and James Deaver.  DNA testing through the KY State Police Forensic Crime Lab indicated that there was a 99.99% chance that James Deaver was the father.  Frodge obtained arrest warrants for both James and Linda Deaver in November, 2007. 
 
Both Deavers were indicted for Incest in February of 2008.  Linda Deaver pled guilty as charged on March 26, 2008 and agreed to testify against James Deaver.  On June 30, 2008, James Deaver also pled guilty as charged.  After receiving proof from defense counsel that James Deaver had voluntarily undergone a procedure to render him incapable of fathering more children, Asst. Commonwealth's Attorney Laura Ward recommended a sentence of 5 years probated for 5 years on the condition that he have no contact with Linda Deaver and continue to register a sexual offender.  Final sentencing for both defendants is July 29, 2008.

GUILTY VERDICT  
Commonwealth v. Betty Doylebetty doyle

On May 31, 2007, Brian Ruff reported to the Covington Police that an unknown person had removed several blank checks from his unlocked vehicle.  Two of the stolen checks were forged and cashed.  One of the forged checks was cashed a Checksmart in Covington.  Covington Police Detective Brian Fuller obtained the security video which showed a woman cashing the stolen/forged check for $180.  Det. Fuller compared the surveillance video to jail booking photos of Betty Doyle and confirmed that she was, in fact, the person cashing the check in the video.  Fuller contacted Ruff who did not know Doyle and said she never had permission to be in his car or to possess his checks, much less cash one.
 
Doyle was indicted on August 30, 2007 for Possession of a Forged Instrument.  Doyle rejected an offer of felony diversion and chose to take her chances with a jury at trial.  The case was called for trial on May 22, 2008.  After two days of evidence and argument, the jury convicted Doyle as charged and recommended a sentence of 1 year in prison.  On June 30, 2008 the court followed the jury's recommendation and sentenced Doyle to 1 year in prison but probated the sentence for 5 years.

On 6/3/08 Deitz pled guilty to 2nd Degree Burglary and 2nd Degree Unlawful Transaction w/Minot.  Asst. Commonwealth's Attorney Leanne Isler recommended a sentence of 12 years in prison.  On 7/1/08 Deitz was sentenced to 5 years in prison.
  
Commonwealth v. Carlos Warfordcarlos warford
Judge: Bartlett
Prosecutor: Amy Burke
Police Agency: Kenton Co. Child Support
 
On 6/8/07 Warford pled guilty to Flagrant Non-Support and a bench warrant was issued for his arrest after he failed to appear for sentencing on 7/30/07.  Warford was apprehended in May of 2008.  Asst. Commonwealth's Attorney Amy Burke recommended that Warford, who owes the mother of his child over $14,000 and the Commonwealth of Kentucky over $26,000, be sentenced to 3 years in prison.  On 6/30/08 Warford was sentenced to 5 years probated for 5 years on the condition that he serve 6 months in the county jail.

Police Agency: Lakeside Park
 
On 7/1/08 Brewer pled guilty to Theft (>$300).  Asst. Commonwealth's Attorney Leanne Isler is recommending a sentence of 1 1/2 years in prison.  Final sentencing is set for 7/29/08.

Police Agency: Ludlow
 
On 7/1/08 Malott pled guilty to Possession of a Controlled Substance (cocaine).  Asst. Commonwealth's Attorney Joe Meadows is recommending a sentence of 1 1/2 years in prison.  Final sentencing is set for 7/28/08.
 
Commonwealth v. Kyle Sheets kyle sheets

Prosecutor: Leanne Isler
Police Agency: Covington
 
On 6/30/08 Sheets pled guilty to Receiving Stolen Property (>$300).  Asst. Commonwealth's Attorney Leanne Isler is recommending a sentence of 2 years in prison.  Final sentencing is set for 7/29/08.
 
Commonwealth v. Daniel Gallagherdaniel gallagher
Judge: Summe
Prosecutor: Laura Ward
Police Agency: Ft. Mitchell
 
On 6/30/08 Gallagher pled guilty to Theft of Identity and Failure to Comply w/Sex Offender Registry (2nd Offense) without the benefit of a plea agreement  Gallagher faces 5-15 years at final sentencing on 7/28/08.

On 6/30/08 Herdman pled guilty to Flagrant Non-Support.  Asst. Commonwealth's Attorney Amy Burke is recommending that Herdman, who has no felony record, be ordered into the felony diversion program for 5 years.  Final sentencing is set for 7/29/08.

On 7/1/08 Rice pled guilty to Possession of a Controlled Substance (cocaine).  Asst. Commonwealth's Attorney Alysha McKinney is recommending that Rice, who has no felony record, be ordered into the felony diversion program for 3 years.  Final sentencing is set for 7/28/08.

On 3/25/08 Tebelman pled guilty to Trafficking in a Controlled Substance (cocaine).  Commonwealth's Attorney Rob Sanders recommended a sentence of 6 years in prison.  On 6/30/08 Tebelman was sentenced to 6 1/2 years in prison.

On 5/30/08 Brown pled guilty to Trafficking in a Controlled Substance (cocaine).  Asst. Commonwealth's Attorney Joe Meadows recommended a sentence of 5 years in prison.  On 6/30/08 Brown was sentenced to 5 years in prison.

On 6/3/08 Jackson pled guilty to Tampering w/Evidence and Possession of a Controlled Substance (unspecified).  Asst. Commonwealth's Attorney Alysha McKinney recommended a 1 1/2 year prison sentence.  On 7/1/08 Jackson was sentenced to 2 years probated for 2 years.

On 5/20/08 Conners pled guilty to Flagrant Non-Support without the benefit of a plea agreement.  On 7/1/08 Conners was sentenced to 3 years probated for 5 years and 90 days of home incarceration.

On 6/3/08 Lauver pled guilty to Possession of a Controlled Substance (cocaine).  Asst. Commonwealth's Attorney Sharif Abdrabbo recommended that Lauver, who has no felony record, be ordered into the felony diversion program for 3 years.  On 7/1/08 Lauver was ordered into the felony diversion program for 3 years.  Lauver faces 1-5 years if diversion fails.

Commonwealth's Attorney Sharif Abdrabbo recommended that Moore, who has no felony record, be ordered into the felony diversion program for 3 years.  On 6/30/08 Moore was ordered into the felony diversion program for 3 years.  Moore faces 1-5 years if diversion fails.
